Если спорящие не равны, формальное правосудие занимает сторону богатой или сильной стороны, но у неимущих есть, по крайней мере, несколько видов защиты: уже существующие законы, права и процедуры. Но когда спорящие не равны и неофициальное правосудие вновь благоприятствует богатым и сильным, побеждённая сторона не может ссылаться на законы, права и процедуры. Если они апеллируют к закону, то их выставляют неразумными несговорчивыми смутьянами. И они остаются с мнением, что им лучше бы не высовываться, идти своей дорогой и принять всё как есть.
Мораль сей басни такова: если вам нужны только методы разрешения конфликтов, меняйте не только методы, но и общество.
